«Общий закон». Первоначально юридическая система в Англии была основана на общепринятых обычаях, привычках и обрядах, и законы не были нигде записаны. Споры между гражданами и преступниками решались согласно местной интерпретации так называемого «общего закона». С XV столетия судебные дела решались по прецеденту, и мало-помалу вошли в обиход законы, написанные парламентом, statute law (статутное право). Сейчас выражение common law ещё употребляется в юридической практике, также встречается в выражениях common law marriage (незарегистрированный брак) и common law wife (сожительница). -
